General terms and conditions of online sales

Acceptance of the online sales conditions

The customer acknowledges having read, at the time of placing the order, the precise conditions of sale stated on the site and expressly declares accepting them without reservation.

The general conditions of sale govern the contractual relations between Tournie and its customer, both parties accepting them without reserve in the sense of the law. These general conditions of sale will prevail over any conditions appearing in any other document. The only exceptions must be obtained by prior, express and written waiver.

This contract is subject to Quebec law (Civil Code of Quebec). In the event of a dispute, the Quebec courts will have exclusive jurisdiction to resolve it.

 

Product prices and online billing

The price of the articles includes the expenses of packing.  The final price indicated in the order confirmation is the final price for the customer. The final price includes the price of the items, the handling and packaging fees and the shipping fees. Tournie reserves the right to change the prices on the www.tourniebijou.com website at any time without notice. The items are invoiced according to the prices in effect at the time of the validation of the payment of the order. Note that the customer will be notified if there is a price adjustment. Any cancellation following a price adjustment will be accepted.

Upon delivery of the package, the customer will receive an itemized invoice addressed to him/her, with details of the taxes applied. We recommend that the customer keep the order confirmation email until the final invoice is received. Customers can pay for an order online with their credit card (Visa, MasterCard, American Express) through the online payment site PayPal.

 

Shopping cart(s) and online order(s)

In order to complete the transaction, the customer's last name, first name, telephone number, postal and e-mail address and billing and shipping address must be provided. The customer who has completed his or her product choices must then validate them as well as his or her contact information and coupon (if applicable). By clicking on "Place my order", the customer shows his commitment and acceptance of the online sales conditions.

From this click, the customer's order is recorded and he/she receives an order number by e-mail. The data recorded by Tournie constitutes proof of the nature, content and date of the order. No cancellation of an order will be accepted without the prior agreement of Tournie.

Use
By using the Tournie website, you agree to all the Terms and Conditions of Sale. They should be read and accepted before placing an order or opening an account. They apply to all Tournie merchandise as well as all images and content found on the website. The use or purchase of merchandise on this website implies the understanding and acceptance of the Terms and Conditions of Sale. Tournie reserves the right to update, modify or change partially or completely this section without notice.

 

Legal Warranty
The Civil Code of Quebec and the Consumer Protection Act provide for legal warranties on hidden defects and on the use of the goods sold. These legal warranties also apply to this sale.

 

Use and disclosure of personal information
Tournie will not disclose your personal information to a third party under any circumstances. We consider the information provided to be highly confidential and we are committed to protecting its confidentiality. The buyer is informed that the information concerning him, provided in the context of this sale or subsequently, may be used by the seller for promotional purposes or services offered by the seller.

 

Inaccuracy and availability of items
While we take great care to ensure the accuracy of the information on this website, if there is an inaccuracy in pricing or availability of a piece of jewelry, Tournie reserves the right to refuse or cancel the order in question. Prices and availability are subject to change without notice. In addition, depending on the volume of online orders, it is possible that a piece of jewelry may not be available before this information is updated in our system. Should this situation occur, we will notify you by phone or email and will try to find another item that will meet your expectations.

 

Delivery Policy

Items will be delivered to the address entered and confirmed by the customer when ordering. The delivery process will only take place once the order has been validated and the payment completed online. The banking payment centers will have given their agreement of payment beforehand. In case of refusal of the payment centers, the order is automatically cancelled.

 

Tournie commits to prepare the order within 3 weeks. Thereafter, the order is delivered within 6 weeks according to the conditions of the agreement between the company and the Canada Post carrier. The prescribed delays apply to working days, excluding routing problems and depending on the availability of the items.

In the event of a stock shortage, the customer acknowledges the 6 to 8 week restocking period. The delivery time starts only when the product is available again.

Cases of force majeure or exceptional events (natural disasters, epidemics, strikes, lockouts, etc.) causing a delay or prohibition of the delivery of goods: Tournie is not responsible for the failure to respect the delivery times announced by the carrier of Canada Post. No compensation or refund can be required from Tournie in case of late delivery due to the responsibility of the carrier. If the customer cancels the order and this cancellation is accepted by Tournie, the company will only refund the amount paid. No other compensation for this cancellation can be required by the customer.

 

Return and refund policy

If the customer changes his/her mind, he/she may return the item within 7 business days of the delivery date, provided that Tournie has been informed of the cancellation and that the return has been granted.

In addition, Tournie may refuse or not refund the customer upon receipt of the returned item in the required condition. Shipping costs to return the product(s) are at the customer's expense.

Tournie may refuse or not refund returned items if the packaging of the items has been opened or if the products have been damaged or worn by the customer. Depend of the case.

 

Cancellation
Tournie reserves the right to refuse or cancel an order for any reason. Also, Tournie may ask you to provide additional information for verification purposes before accepting an order. In either case, Tournie will contact you.

Return

All costs of transport, storage and handling are the responsibility of the customer. The return of items is at the customer's expense, risk and peril.

If a package is lost or stolen due to a problem with the carrier, the customer must report it to Tournie within a reasonable time. To report a lost or stolen package, the customer must contact Tournie directly by email at the following address: info@tourniebijou.com. Upon receipt of the email, Tournie will initiate an investigation with the carrier and make the information found available to the customer. The investigation will last a minimum of 4 weeks in the case of a lost or stolen package. In the case of a real loss following the investigation with the carrier, Tournie can proceed with another delivery or a refund by credit card or check depending on the compensation from the carrier.

The tournie.shop website, including the brand, logo, photos, texts, video files, graphic elements and all other information are the property of Tournie. Any reproduction, modification or use of these elements is strictly forbidden without the written consent of Tournie. Legale action can be taken.

Tournie is committed to upholding your right to privacy as prescribed by the laws of Québec and Canada respecting the protection of personal information.
